Online Store Terms of Use

Application of Terms and Conditions

1. These Online Store Terms of Use (Terms of Sale) govern the supply of all products (Goods) by Prima to the exclusion of all other terms and conditions, including any terms and conditions contained in a buyer’s order, unless otherwise expressly agreed in writing.
2. These Terms of Sale may be changed at any time by Prima by posting them to this site.

Credit and Returns

3. A Buyer is unable to add or delete items to/from orders once they have been lodged and paid for.
4. Buyers are requested to inspect Goods immediately upon delivery and to give notice to Prima’s Customer Service Department (phone 1800 226 180) within 48 hours after the date of delivery of any claim that the Goods are defective. The notice should detail the original invoice number and amount, batch codes and bar codes of the Goods and the reason for return.
5. Prima’s Customer Service Department will advise the “Returns Log Number” for the Goods. No returns shall be accepted by Prima unless authorised by Prima’s Customer Service Department and a “Returns Log Number” is issued. Prima will not accept returned Goods unless the “Returns Log Number” is clearly marked on the Goods being returned.
6. Prima will not accept freight forward charges when Goods have been consigned by any transport company other than a carrier that has been authorised by Prima.
7. Accepted claims will be credited to the credit card used to make the original purchase.
8. Other than where permitted under these Terms of Sale or where required by law, Goods are not returnable to Prima and no credit will be given for any such purported return.
9. Subject to a buyer’s rights under the Australian Consumer Law, if a buyer fails to give notice to Prima in accordance with this “Credit and Returns” clause the Goods are deemed to have been accepted and the buyer must pay for the Goods in accordance with these Terms of Sale.

Delivery Policy

10. Prima’s dispatch facility is located in Sydney and delivery times will vary according to Australia Post’s schedule. Please allow up to 10 working days for each order to be processed and delivered. Orders are sent via eParcel to the address specified on the order.
11. If you feel that your order has not been received within a reasonable time frame, and you have checked that the Goods are not located at your local post office, please contact Prima promptly on 1800 226 180.

Warranty and Liability

12. Prima excludes all liability in connection with the sale and supply of Goods (or advice regarding Goods) other than that which may not be excluded under the Australian Consumer Law or other relevant legislation. For the avoidance of doubt, this exclusion includes but is not limited to an exclusion of all conditions and warranties implied by custom, the general law, damages suffered by a buyer arising in any way out of the supply, delay in supplying or failure to supply Goods, except as set out in the Credit and Returns clause.
13. Where liability cannot be excluded by law, any liability incurred by Prima in relation to the supply of Goods is limited to the extent provided for by Australian Consumer Law. Accordingly, Prima’s liability for breach of any warranty implied into these Terms of Sale by law (which cannot be excluded) is limited to the replacement of the Goods or the supply of equivalent Goods or, at Prima’s option, the refund of the price paid for the Goods.

General Terms

14. These Terms of Sale contain the whole contract between Prima and a buyer in relation to the supply of Goods and supersede all prior representations and agreements between the parties. No variation of these terms shall be binding on Prima unless agreed in writing.
15. A provision of or a right created under these terms in favour of Prima may not be waived or varied except in writing signed by Prima. Prima may elect not to exercise its rights arising from a breach of any provision of these Terms of Sale and such election, even if the breaches are continuous and multiple, shall not create any estoppel or presumption against Prima.
16. These Terms of Sale are governed by the laws in force in New South Wales, Australia. Each buyer agrees to irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
